FDA Adviser Tied to Bayer

Some FDA advisers are tied to Bayer, the Wall Street Journal reported. Additionally, the Project on Government Oversight outlined the conflict in a letter to the FDA on January 11, 2011.

This conflict occurred at December 8, 2011, hearing in which two FDA advisory committees, the Reproductive Health Drugs Advisory Committee and the Drug Safety and Risk Management Advisory Committee met to consider the benefits and risks of the oral contraceptives Yaz and Yasmin and related contraceptives containing the drug drospirenone.

Yaz and Yasmin, manufactured by Bayer HealthCare Pharmaceuticals, Inc. are among the most popular and profitable oral contraceptives in the U.S. An Associated Press article recently stated that “Yaz, Yasmin and related drospirenone-containing pills were Bayer’s second-best-selling franchise last year at $1.6 billion in global sales.”

These same FDA advisers, in a recent vote, said the benefits of four well known Bayer AG (BAYRY) birth control pills outweigh the blood clot risk. What the FDA didn’t reveal is that three of the advisers have had direct ties to Bayer, reports the Wall Street Journal. Reference Link

The Bayer Group currently owns some 78,000 patents or patent applications. Although in our Pharmaceuticals segment the patents on Avalox® / Avelox®, Betaferon® / Betaseron®, Kogenate®, Levitra®, Magnevist®, Mirena®, Nexavar®, Xarelto®, yaz®, Yasmin® and Yasminelle® are particularly important to our business, we believe that no single patent (or group of related patents) is crucial to our business as a whole.
